Nach dem Vorbild der französischen Tribunaux de commerce wurden spätestens im neunzehnten Jahrhundert in fast allen europäischen Staaten Spruchkörper eingerichtet, die zu einem Teil, überwiegend oder gar ausschließlich mit Kaufleuten besetzt waren. Noch heute gibt es Handelsgerichte in zahlreichen europäischen Staaten ? etwa in Deutschland, Frankreich, Belgien, Österreich und in einigen Kantonen der Schweiz ? und zwar in unterschiedlichen Formen und mit unterschiedlichen Zuständigkeiten.
