Die Entscheidungen sind für die Gerichte der Mitgliedstaaten bindend. Das Vorabentscheidungsverfahren soll die Einheitlichkeit der Rechtsprechung der Gerichte der Mitgliedstaaten im Hinblick auf das EU-Recht gewährleisten. Rund die Hälfte aller beim EuGH anhängigen Verfahren sind Vorabentscheidungsverfahren.
