In Deutschland ist ein Kreditinstitut in § 1 Kreditwesengesetz gesetzlich definiert als ein kaufmännisches Unternehmen, das Bankgeschäfte betreibt. Die Bezeichnung ?Bank? dürfen nach § 39 KWG nur Unternehmen führen, die eine Banklizenz besitzen. Die Gesamtheit aller Kreditinstitute sowie die gesetzlichen Regelungen dazu bezeichnet man als Bankwesen.
