Beim Finanzierungsleasing als typischem Leasing überwälzt der Leasinggeber das Investitionsrisiko auf den Leasing-Nehmer. Der Geber trägt somit nur das Kreditrisiko und eventuell vereinbarte Dienstleistungen. Der Leasing-Nehmer wird während der Vertragslaufzeit nicht dinglicher Eigentümer des Vermögensgegenstandes, wenn ihm die Sache auch wirtschaftlich als Eigene zugerechnet werden kann, da der Leasing-Geber kein Interesse an einem Rückerhalt des Besitzes der Sache hat. Nach Ablauf der Vertragslaufzeit steht dem Leasing-Nehmer üblicherweise eine vertraglich eingeräumte Kaufoption der Sache zum Preis des Restwertes zu. Es handelt sich daher beim Finanzierungsleasing nach der Rechtsprechung um einen atypischen Mietvertrag mit Überwälzung der Sach- und Preisgefahr auf den Leasing-Nehmer in Verbindung mit einer späteren Kaufmöglichkeit zu dem geringeren Restwertkaufpreis.
