Glaubhaftmachung bedeutet im Zivilprozess ein herabgesetztes Beweismaß. Der Beweisführer muss nicht wie beim Beweis dem Richter die vollständige persönliche Ãœberzeugung von der Richtigkeit der Tatsachenbehauptung verschaffen, sondern hat die Tatsache schon dann glaubhaft gemacht, wenn diese dem Richter wahrscheinlich erscheint. Daneben befreit die Möglichkeit der Glaubhaftmachung, die die Zivilprozessordnung in bestimmten Fällen ? insbesondere bei der einstweiligen Verfügung ? einräumt, von der Einhaltung der Beweisformen des Strengbeweises und der bei ihrer Erhebung vorgeschriebenen Förmlichkeiten. Deshalb kann der Beweisführer sich auch auf eine eidesstattliche Versicherung stützen. § 294 Abs. 1 ZPO legt insoweit fest: ?Wer eine tatsächliche Behauptung glaubhaft zu machen hat, kann sich aller Beweismittel bedienen, auch zur Versicherung an Eides statt zugelassen werden.?
